2. INFORMATION OBLIGATION

The protection of personal data of individuals is safeguarded in Portugal by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, ("GDPR") and by Law No. 58/2019, of 8 August, which ensure the protection of individuals with regard to the processing of personal data and the free movement of such data.

"Personal data" means any information, of any nature and regardless of its support, including sound and image, relating to an identified or identifiable natural person, so protection does not cover data of legal entities. A person is considered identifiable who can be identified directly or indirectly, in particular by reference to an identification number or to one or more specific elements of their physical, physiological, mental, economic, cultural or social identity (for example, their name associated with their phone number or their email address).

For the purposes of this Privacy Policy, representatives of Study Centers, Teachers and Students will be referred to as "Users / User". References to "Professionals" do not include Students.

By reading this Privacy Policy, the User is informed about the processing of their personal data carried out by Unicage Soft Programming Laboratory Software Europe, Lda. ("Unicage") through the website https://davint.es/ ("Website").

3. MINORS

Unicage does not intentionally allow users under 13 years of age to register on the Website without the prior consent of their respective parental responsibility holders.

If Unicage becomes aware of the collection of personal data from a user under 13 years of age through the Website, without the consent of the respective parental responsibility holder, it will take the necessary actions to delete such data.

If you are the holder of parental responsibilities for a user under 13 years of age registered in our service without your consent, please contact our service through the email address info@unicage.com to request the deletion of such personal data from our system.

4. PURPOSES OF PERSONAL DATA PROCESSING

The personal data that Unicage collects and otherwise processes through the Website will be used solely for the following purposes:

  • Manage the use of the Website and ensure the provision of services available therein;
  • Provide support and communicate with Users, particularly following requests for information, complaints or technical support requests;
  • Dissemination of information and/or campaigns, promotions and news about services provided through the Website;
  • Analysis of service usage to identify User habits and trends in order to improve services offered and meet specific User needs;
  • Compliance with legal obligations to which Unicage is bound or defense of rights that assist it.

Unicage guarantees the confidentiality of all data provided. Notwithstanding that Unicage proceeds with the collection and processing of data in a secure manner that prevents its loss or manipulation, using the most appropriate techniques for this purpose, it should be noted that data collection on open networks does not allow the circulation of personal data under conditions of absolute security, with the risk of these being accessed and used by unauthorized third parties.

When applicable, failure to respond to data marked as mandatory may result in the impossibility of responding to the data subject's request.

5. LEGITIMACY FOR PERSONAL DATA PROCESSING

Unicage processes User data:

  • When they express their free, specific, informed and unambiguous consent for the processing of their personal data for certain purposes;
  • When necessary for the execution of a contract in which the data User is a party, or for pre-contractual measures at the User's request;
  • To comply with legal obligations to which Unicage is bound;
  • For the purpose of legitimate interests pursued by Unicage or third parties, except where the interests or fundamental rights and freedoms of the data subject that require the protection of personal data prevail.

The User guarantees that the information provided is true, accurate, complete and up-to-date, and is responsible for any damage or loss, direct or indirect, that may be caused as a result of the violation of this obligation.

If the provided data belongs to a third party, the User guarantees that they have informed the said third party of the aspects contained in this document and obtained their authorization to provide their data to Unicage for the indicated purposes.

6. RETENTION PERIOD

Unicage only retains personal data for the period that proves necessary or mandatory for the fulfillment of the purposes described above, applying appropriate information retention criteria for each processing and in line with applicable legal and regulatory obligations.

Unicage maintains personal data in its systems in such a way that it is possible to identify data subjects according to the following criteria:

  • For a period not exceeding the pursuit of the purposes for which they were collected, provided that legal or contractual obligations do not provide otherwise;
  • To comply with specific legal or contractual obligations;
  • When applicable and legitimate, until the eventual request for opposition or deletion by the data subject.

7. DATA COMMUNICATION

In addition to communications made in compliance with legal obligations, the data subject's personal data may be known, in addition to Unicage, by partners and subcontractors, exclusively for the purposes of providing the contracted service, whether they are:

  • Email services;
  • Information Technology services, namely application management and administration, infrastructure provision and analytics;
  • Audit services and other similar services;
  • Payment and fraud control services;
  • Other service providers in the areas of support and consulting for Unicage's activity.

The provided data may also be transferred to official entities in compliance with legal obligations.

Disclosure of personal data may also occur, exclusively for the purposes indicated above, in accordance with the consents granted by the data subject.

8. INTERNATIONAL DATA TRANSFERS

In the event of any processing of personal data outside the European Economic Area, this will only occur through the adoption of adequate safeguards and the required level of protection, in accordance with personal data protection legislation.

9. INFORMATION SECURITY

Unicage has implemented appropriate technical and organizational security measures to ensure the security of personal data provided by the User, aiming to prevent its alteration, loss, processing and/or unauthorized access, taking into account the current state of technology, the nature of stored data and the risks to which they are exposed.

Personal data is processed with the legally required level of protection to ensure their security and prevent their alteration, loss, processing or unauthorized access, taking into account the state of technology, with the User being aware and accepting that Internet security measures are not impregnable.

Whenever accessing personal data, Unicage undertakes to:

  • Store them through legally required security measures, of a technical and organizational nature, that guarantee their security, thus preventing alteration, loss, processing or unauthorized access, in accordance with the state of technology at each moment, the nature of the data and the possible risks to which they are exposed;
  • Use the data exclusively for previously defined purposes;
  • Implement physical security measures for facility protection;
  • Ensure that data is processed only by employees whose intervention is necessary to satisfy the data subject's request, with them being bound by the duty of secrecy and confidentiality. If there is a possibility of information being disclosed to third parties for the aforementioned purposes, these must be obliged to maintain due confidentiality in accordance with what is provided for in this document.

Data used to make payments, particularly those relating to credit/debit cards, are provided directly on the respective service providers' platforms. Unicage does not have access to this data.

If Unicage subcontracts to other entities the provision of services involving the transfer of personal data, these entities will be obliged to adopt the necessary technical and organizational measures to protect personal data against destruction, loss, alteration, disclosure, unauthorized access or any other type of illicit processing.

10. EXERCISE OF RIGHTS

In accordance with the provisions of the GDPR, the User may exercise their rights of access, rectification, deletion and, when applicable, limitation of processing, portability, opposition and withdrawal of consent, requesting it in writing through any of the following means, specifying the right or rights they wish to exercise:

The Website may contain advertising, links or other content that links or redirects to pages and services of suppliers, advertisers, affiliates, Unicage sponsors and other third parties.

However, Unicage does not control the content or links that appear on these pages and is not responsible for the practices used by these pages or Websites. Unicage advises Users to visit the privacy policy of such pages, as well as their terms and conditions.

Searching or interacting on any other website, including those that have an external link to the website, are subject to the terms and conditions of that Website, with Unicage in no case being responsible for such access and use.

13. CHANGES TO THE PRIVACY POLICY

To ensure the adequacy of the document, Unicage reserves the right to review this Policy at any time it deems appropriate, so it is recommended that Users check this privacy policy regularly and/or each time they access the Website.
